Judgment: Store design protectable as a trademark

Apple can have the design of its stores protected as a trademark. The leading textile industry magazine, Textilwirtschaft, quoted Dr. Nicolás Schmitz, intellectual property attorney at the Munich office of the law firm of Grünecker, saying that this decision by the Court of Justice of the European Union was also a signpost for the fashion industry. He recommends protecting shops as a trademark, in order to secure the high investments in the store concept and create a unique selling proposition for the latter. The particular challenge now, as per Dr. Schmitz, consists in identifying the individual values to be protected, on a case-by-case basis.
