The Federal Patent Court has overruled the registration of a red colour trademark for the Sparkasse Financial Group. "It is almost certainly going to be difficult for the Sparkasse Group" comments Grünecker Attorney Dr Holger Gauss in the "Süddeutsche Zeitung”. Colour trademark requirements are high, and in the next stage of the proceedings at the Federal Supreme Court, it may well prove difficult to meet them, expects Dr Gauss.
