With the now published judgment of the Federal Court of Justice (BGH file number X ZR 44/22) of April 25, 2024, the first-instance judgment of the Federal Patent Court (BPatG file number 5 NI 3/21 (EP)) was confirmed to declare the German part of the European patent EP 1 581 427 of Formax Inc. invalid in its entirety. The infringement action pending at the Düsseldorf Higher Regional Court (file number I-2 U 19/24) was dismissed accordingly in a ruling dated July 22, 2024.
