European Court of Justice renders negative opinion on planned European Patent Court systemIn its opinion of March 8, 2011, the European Court of Justice concluded that the planned system for a European Patent Court is not in conformity with European law. This Court could – through its decisions – violate standing European law, and this would not lead to the consequence that a single member state of the EU is liable. According to the European Court of Justice, this system would, consequently, bring about a lack of liability and responsibility regarding the uniform application of European law.
