The European Commission provides the draft for a regulation concerning the “enhanced cooperation” for creating a uniform patent protection

According to the draft, the twelve member states which intend to participate in this “enhanced cooperation” (Denmark, Germany, Estonia, Finland, France, Lithuania, Luxembourg, the Netherlands, Poland, Slovenia, Sweden and the United Kingdome) can file a request with the European Patent Office for a “uniform effect” of European Patents. Patents having “uniform effect” can only uniformly be granted, transferred, revoked or expire within the participating member states. In the transition period, a system will be created for computer-generated translations in all office languages. In this transition period the complete translation of the European patent specification in English is required. During litigation, the patent owner must, upon request of the Court, provide a complete translation into the language of the proceedings and, at the choice of the presumed patent infringer, into the official languages of either the member state where the presumed patent infringement has taken place or where the presumed patent infringer is domiciled.
